Any DUI court process will begin with the arrest of a driver for driving under the influence. The driver will then be held in custody, where a bail amount will be set or where the person will be released on his or her own recognizance/Pre-trial release.

Your first court appearance will be your arraignment, wherein the judge will inform you of your rights and of the specific DUI charges that you face. At this time, you will be able to enter a plea before the court, of not guilty, guilty or no contest. Your Tampa DUI attorney will be able to enter a plea of not guilty on your behalf.  In Tampa Florida, upon request, the State Attorney has 15 days to provide the dui defense lawyer with all of the documents in the case including police reports, breath test documents and a video of the investigation.

Once all of the documents have been received, the DUI defense lawyer will be able to file  pretrial motions to exclude evidence such as a motion to suppress or other motion which will serve to help you reach a favorable outcome for your case. If the defense attorney has conducted a proper investigation of your case, it could be that blood alcohol concentration (BAC) test results can be suppressed due to an improperly calibrated breathalyzer machine or other error by law enforcement.

During your Tampa DUI trial, your case will be heard in front of a jury. The attorney will be able to present your case and present witnesses and evidence in your favor, as well as cross-examine witnesses that the State (the prosecution) provides. The jury will then decide the verdict.
