In Florida, DUI manslaughter is a second degree felony punishable by a maximum of 15 years in state prison. If the driver was accused of leaving the scene of the accident, he or she will face a first degree felony with a maximum 30 years in prison. The main witness in a Florida DUI manslaughter case is called the traffic homicide investigator (THI). This officer takes measurements at the scene and determines the cause of the crash. In addition, the State Attorney will have blood experts as well as the officers at the scene. In every DUI case the State is required to prove not only that the individual was above a .08 blood alcohol level (or impairment), but they must also prove that the person charged with the DUI manslaughter either caused or contributed to the accident.

Unlike a traditional DUI case, a person is required to submit to a blood test in a DUI manslaughter. However, blood tests are often inaccurate and never represent the driver's blood alcohol level at the time of the crash as required by law.
